Notes:


The Local Government (Miscellaneous Provisions) Act 1982 Part VIII requires that the following types of skin piercing need be registered with the Council. Applicants wishing to register should note that as from the 2nd August 2010 South Lakeland District Council have adopted section 120 of the Local Government Act 2003 which adds cosmetic body piercing and semi permanent skin-colouring to the practices which are required to be registered with the Council.


 Cosmetic Piercing, Tattooing, Electrolysis, Acupuncture, Semi - permanent skin colouring


In respect of acupuncture both the operator and the business premises must be separately registered with the local authority. One application will cover both registrations where the applicant is both the proprietor of the premise and operator (i.e. the person who gives the treatment) In these circumstances only one fee will be charged.


Cosmetic piercing, ear piercing, tattooing, electrolysis and semi permanent skin colouring can only take place in a business premises where the premises and applicant are registration with the local authority. There is no requirement for the operator (i.e. the person who gives the treatment) to be registered and as such an operator employed by the proprietor of a registered business will not need to be registered within the District.


However where an individual is self employed and provides treatment in a registered business premises for which he/ she is not the proprietor then that person will be deemed to be carrying on a business and as such will need to make application for personal registration.


An individual who is registered with the local authority in respect of the above activities will be able to provide treatment for which he or she is registered in any business premises registered for that purpose within the District.


The applicant must ensure that the procedures, equipment and facilities used are safe and hygienic in order to prevent the spread of disease. An applicant shall comply with the general duty of care under the adopted byelaws and the requirements required by the Health and Safety at Work etc Act 1974.

 

Once an application has been made and a fee has been paid, an inspector will undertake an inspection of the premises. If the inspector considers the applicant's procedures and the premises to be suitable, then registration will be approved. The Inspector will also check compliance with the bye-law requirements as well as ensuring that general health and safety requirements are being met. The inspector will be pleased to offer any advice or give any help if you are unsure as to how to meet these obligations.


NB

Ear piercing and cosmetic body piercing are encompassed in the single term “cosmetic piercing”.


Micro-pigmentation, semi-permanent make-up and temporary tattooing are covered by the umbrella term “semi-permanent skin-colouring”. Semi-permanent skin colouring is defined as “the insertion of semi-permanent colouring into a person’s skin”
