The Board of Commissioners of Lorain County, Ohio, met in regular session on August 17, 2016 with all members present.

Commissioner Lundy moved the following resolution:


WHEREAS, we hereby clarify Resolution No. 16-459, adopted July 20, 2016; and


WHEREAS, the Lorain County Commissioners have issued a Certificate of Estimated Resources for the year of 2016 (as of 6/8/16) to be $54,384,904.64 million dollars; and


WHEREAS, the carryover from 2015 was $6,387,941.67 million dollars (unemcumbered cash balance as of 1/1/16); and


WHEREAS, the sales and use tax in Lorain County is one of the lowest in the State of Ohio; and


WHEREAS, said tax is necessary for the preservation of;


And;


THEREFORE, the Board of Commissioners of Lorain County has determined that it is necessary for the immediate preservation of the public peace, health and safety of the citizens of the County.


FURTHER BE IT RESOLVED, that the revenues generated from said tax should be distributed as follows:


5739.026(A)(2) 50% to general revenues for Loran County Transit


5759.026 (A)(3) 50% to general revenues for Lorain County General Fund


This allocation will remain for a minimum of 5 years, after which it may be changed, pursuant to law.

NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF LORAIN COUNTY, OHIO:


That the Clerk of the Board publish in the Chronicle Telegram and Morning Journal on June 17 & 24, 2016 notice that the Board of Commissioners held its official public hearings on Wednesday, July 6, 2016 at 9:45 a.m. and Tuesday, July 12, 2016 at 6:00 p.m. in the J. Grant Keys Administration Building, 226 Middle Avenue, 4th Floor – Meeting Room B, Elyria, Ohio to consider the following:


  1. For the purpose of providing additional general revenues for Lorain County, pursuant to Revised Code Section 5739.026(A)(2) and (A)(3), levy an increase of the existing rate of tax by one quarter of one percent (1/4%) for a continuing period of time, upon every retail sale made in Lorain County , except sales of watercraft and outboard motors required to be titled pursuant to Chapter 1548 of the Revised Code and sales of motor vehicles;

and said tax shall be in addition to the tax levied by Section 5739.02 of the Revised Code and any tax levied pursuant to Sections 5739.021 or 5739.023 of the Revised Code.

II. For the purpose of providing additional general revenues for Lorain County pursuant to Revised Code Section 5741.023, levy an increase of the existing rate of tax by one-quarter of one percent (1/4%) for continuing period of time, on the storage, use or other consumption in Lorain County of the following:

(1) motor vehicles, and watercraft and outboard motors required to be titled in Lorain County pursuant to Chapter 1548 of the Revised Code and acquired by transaction subject to the tax imposed by Section 5739.02 of the Revised Code; and

(2) in addition to the tax imposed by Section 5741.02 of the Revised Code, tangible personal property and services subject to the tax levied by the State of Ohio as provided in Section 5741.02 of the Revised Code,

and tangible personal property and services purchased in another county within the State of Ohio by a transaction subject to the tax imposed by Section 5739.02 of the Revised Code;

and said tax levied pursuant to Section 5741.023 of the Revised Code on the storage, use, or other consumption of tangible personal property and on the benefit of a service realized shall be in addition to the tax levied by Section 5741.02 of the Revised Code and, except as provided in division (D) of Section 5741.021 of the Revised Code, any tax levied pursuant to Sections 5741.021 and 5741.022 of the Revised Code;

That, pursuant to 5739.026 (A) and 5741.021(A), that the Board of Elections of Lorain

County submit the question of the tax increase to the electors of Lorain County at the next general election, November 8, 2016, to become effective April 1, 2017; and


That the Clerk transmits a certified copy of this resolution to the Board of Elections and the Tax Commissioner.

BE IT RESOLVED by the Lorain County Board of Commissioners that we hereby approve & enter into a Purchase of Youth Mentoring Services Contract on behalf of Children & Families Council with Catholic Charities Corporation for the Fiscal Year 2017. Said contract can be found in the Commissioners/Purchasing Department and at Children & Families Council’s Offices.


1) Catholic Charities Corporation $10,000.00

FURTHER BE IT RESOLVED said monies are available from the Family Center Support & Services (FCSS) grant and the contract will be in effect from September 1, 2016 through June 30, 2017 and authorize said payments to be made within said contracts with total reimbursement not to exceed $10,000 for the contract term.

WHEREAS, a Notice to Bidders requesting bids for the Amherst Parking Facilities Improvements for Amherst, Ohio, will be published in the Lorain Morning Journal on August 19th 2016 and August 26th , 2016 as follows:

NOTICE TO BIDDERS

Sealed bids will be received until 2:00 p.m., September 2nd, 2016, by the Lorain County Board of Commissioners; Purchasing

Department; 226 Middle Avenue, Elyria, OH 44035, for the furnishing of all labor, material, and equipment for the Amherst Parking Facilities Improvements, Amherst, Ohio using various materials in accordance with all local, state and federal laws and guidelines. All interested parties are welcome to attend the bid opening to be held immediately following the deadline in the Commissioners’ Public Hearing Room located on the fourth floor of the Lorain County Administration Building.


The estimated cost of all work for this project is: $142,470.00

The project must be completed by November 23rd, 2016


A mandatory pre-bid meeting for contractors will be held on Wednesday, August 23rd 2016 at 9:30 a.m. at Main Street Amherst, 255 Park Ave, Amherst, Ohio 44001.

All contractors involved with this project will, to the extent practicable, use Ohio products, materials, services and labor in the implementation of this project. In order to bid this project you must be a plan holder of record with the Purchasing Department.

Bids must be accompanied by a bid bond, certified check, cashier’s check or Letter of Credit equal to ten percent of the amount bid or a Bid Guaranty and Contract Bond in the form bound in the Project Manual for the full amount of the bid. Should any bid be rejected such instrument will be forthwith returned upon proper execution of a contract. The Board of Commissioners reserves the right to reject any and all bids and to waive any informalities or irregularities if it is deemed in the best interest of Lorain County to do so. Any interpretation, correction or modification to the specifications desired shall be submitted in writing to James R. Cordes, County Administrator, 226 Middle Avenue, Elyria, Ohio 44035 and must be received at least seven (7) days prior to the date of the bid opening.

WHEREAS, bids, which included contingencies of $7,000.00, will be received and opened on September 2nd, 2016, for the Amherst Parking Facilities Improvements, Amherst, Ohio:


NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Lorain County, Ohio, we hereby award a contract to the lowest responsible bidder in accordance with the Community Development Block Grant procurement policies and Ohio Revised Code for the Amherst Parking Facilities improvements for the City of Amherst which includes a contingency of $7,000.00 for approved change orders. CDBG Set-Aside Year 15 Grant Funds in the amount of $113,400.00 will be provided for this project are available from account CDBG PY’15 (Contract Services). The City of Amherst will provide the remaining contract balance of $29,070.


BE IT FURTHER RESOLVED, that we do hereby issue a Notice to Proceed effective on or before September 14th, 2016, and to complete said contract on or before November 23rd, 2016.


FURTHER BE IT RESOLVED, the County Administrator is hereby granted the authority to notify the County Auditor to release retainage at the completion of the contract.


Said bid was the lowest and most responsive bid received complying with specifications.

BE IT RESOLVED, by the Lorain County Board of Commissioners that we hereby authorize Purchase of Service agreements between Lorain County Department of Job and Family Services and various vendors for

Title XX Social Services Block Grant funded services for federal fiscal year 2017.

Said agreements are considered a part hereof to this resolution and by reference thereto and can be found on file in the Commissioners/Purchasing Department and Lorain County Department of Job and Family Services. These agreements are effective from October 1, 2016 through September 30, 2017.


  1. Lorain County Safe Harbor, Lorain Ohio for domestic violence services in an amount not to exceed $12,500.00.

2) Volunteer Guardianship Program of Lorain County, Elyria, Ohio for adult guardianship services in an amount not to exceed $9,000.00

FURTHER BE IT RESOLVED, we hereby authorize the Director of Lorain County Department of Job and Family Services to execute these agreements and amend these agreements for changes in the programming content and to increase the value of these agreements on behalf of the Lorain County Commissioners, as needed, with the Prosecutor’s approval as to form.


BE IT FURTHER RESOLVED, we hereby authorize said payment for services to be made within the amount set above for contracts and/or subcontracts.
