CORRECTION TO CERTIFICATION
If an error is detected after an annual recertification, interim, move in etc have completed and sent electronically through TRACS and on the HAP voucher and you must do a correction to the certification.
A Correction to a Certification is DIFFERENT than an Interim. A Correction is completed when a certification is incorrect. Therefore, the effective date of the correction will be the same date as the effective date of the incorrect certification. An Interim is done when there is a significant change in income or medical expenses between recertification periods.
The first thing to do is identify what is wrong on the original certification. Once that is determined complete another income worksheet with using all information used on the original certification that had the error and add or change only the information justifying/requiring a correction to the certification.
Once you complete the income worksheet, enter the information from the income worksheet into the Yardi software program. Please refer to the Yardi manual for step by step instructions on how to complete a correction to a certification in Yardi.
After the information is entered into Yardi, review the HUD 50059 and confirm that the resident rent calculation you have on your income worksheet matches what is on the HUD 50059. Also, review the actual information on the HUD 50059 to be sure it is correct. Sometimes, you may calculate the same rent on the income worksheet and the HUD 50059 but the information may not be accurate. Once you have confirmed all the information, follow the Yardi manual instructions to print the HUD 50059 Full Pack.
The next step is to take the printed HUD 50059 Full Pack and schedule a time for the resident to come in to sign the completed documents. When the resident comes in to go over the recertification provide them the new rent amount and effective date.
If it was a decrease in rent, it will be effective on the same date of the original certification.
If it was an increase in rent due to owner error, you must give the resident a full thirty day notice, but the effective date will still be the effective date of the original certification. However, if the correction is done due to incorrect/lack of information provided by the resident, then you do not have to give the resident a thirty day notice.
Example of increase in rent due to owner error: The Annual Recertification effective date was October 1, 2010. I completed a correction to the Annual Recertification on December 5, 2010 and the rent increased $5.00. The effective date of the correction will be October 1, 2010, however the resident is not responsible to pay the new higher rent until February 1, 2011.(Because we have to give the resident a FULL 30 days notice) Therefore, the $5.00 increase for October, November, December, and January (Total of $20) will have to be written off as bad debt due to management error. If this situation occurs please contact your Regional Property Manager for assistance.
Example of increase in rent due to tenant error: The Annual Recertification effective date was October 1, 2010. I completed a correction to the Annual Recertification on December 5, 2010 and the rent increased $5.00. The effective date of the correction will be October 1, 2010, however the resident is responsible to pay the new higher rent starting October 1, 2010 (We do not have to give the resident a FULL 30 days notice because they failed to report information in a timely manner).
All corrections must be signed by both the resident and Community Manager. If the Community Manager has a PM/PMIC license then the community manager may sign all the legal documents (HUD 50059 Full Pack). If he/she does not a PM/PMIC license these documents must be flagged for the Regional Property Manager to sign on the next visit. The following are legal documents:
Lease
Pet Lease (if applicable)
HUD 50059
TIC (Tax Credit and HOME Programs)
All corrections go on the right hand side of the resident file on top of the original certification that had the error. With the exceptions of Move In Corrections they go on the left hand side.
Each Certification must be separated with a legal size colored sheet of paper and labeled with certification effective date and reason for correction.
ie. If the residents correction certification is effective October 1, 2010, then the bottom of the colored sheet of paper should state “Correction to AR 10/10”. Also, on the same colored sheet of paper, state why the correction certification was completed.
Then scan the correction certification to the Regulatory Compliance Coordinator (RCC) within seven days of the documents being signed. REMINDER: Make sure that you have already put in the proper order and include previous 50059 prior to sending to RCC. Also make sure you name the file and subject line properly before sending email.
