Process of being deemed a Relevant Person
The decision to request that a PHP consider a foster carer as a Relevant Person
T his decision to purse relevant person status for a foster carer is to be taken in consultation with the child or young person’s placing Social Worker, the foster carer and their Supervising Social Worker. The foster carer is to be supported and given time to reflect on the importance of this decision
The request must be considered at a Pre-Hearing Panel
If there is insufficient time to call a PHP, or the Hearing themselves identify someone as having a significant involvement in the upbringing of the child of young person, the Hearing can deem someone as a relevant person. This decision has to be made at the beginning of proceedings and the panel must then consider whether to continue with the hearing as the carer may not have had sight of all the papers available to the Panel

Appeal decision
The foster carer can appeal against the decision to not make or not make the carer a deemed relevant person. The child or young person and relevant persons can also appeal against the decision to make or not make the carer a relevant person.

Removing Relevant Person Status
Once Relevant Person status is granted, it can only be removed by a Hearing or PHP if the person ceases to have significant involvement in the upbringing of the child or young person’s life. It is important that a request is made to remove relevant person status after a child or young person has moved otherwise the carer will continue to have rights and responsibilities including receiving all reports and information re future hearings.
Those who can make a request are: the foster carer; child or young person; social worker; relevant persons. This decision can also be appealed.
