Subject: Breach of Water Framework Directive in Martorell

The town council in Martorell built a car park on the riverbed of the River Anoia shown on its current urban plan. Last July, the ACA [Catalan Water Board], the body in Catalonia’s Regional Government responsible for water, gave the Martorell town council permission for this new car park on the bed of the River Anoia (shown on its current urban plan) despite this being an area subject to flooding. The work was carried out without a hydraulic plan or an environmental impact study as required by the ACA. The ACA even fined the Martorell town council and ruled that it must return the developed area to its original state as the work was illegal, which led the Town Council to file for judicial review against the ACA. Some months later, however, it has changed how it sees the project and it is now using the tools in the Water Framework Directive for purposes completely contrary to those for which they were created. Instead of preserving and protecting the river area through river planning, these tools are being used in Martorell to occupy the flood plain, in order that it may be reclassified at a later date and transformed into urban ground. For some time now, bodies such as Martorell Viu have been denouncing these works, which involve dredging part of the river, as illegal. Under Directive 2000/60/EC of the European Parliament and of the Council of 23 October 2000 establishing a framework for Community action in the field of water policy, Member States are required to monitor very closely any construction that may affect a riverbed or a river basin. This does not appear to have happened in the case of the River Anoia in Martorell.

In the Commission’s opinion, do the works in Martorell authorised by the ACA comply with the Water Framework Directive?

Does the Commission believe that the Martorell town council has acted correctly in building a car park in an area subject to flooding without due authorisation from the body responsible for water policy?

What steps has the Commission taken to ensure that it has all the information it needs in order to assess the plan for this work?
