1. Harmonise existing laws with two new Laws on Police Reform

Ministry of Security

The amendments to the following four laws have been adopted: Law on Ministries and other Administrative Authorities (dated 23 July 2009, Official Gazette no. 59/09), Law on Police Officers (dated 27 April 2009, Official Gazette no. 35/09), Law on State Investigation and Protection Agency (dated 18 June 2009, Official Gazette no. 49/09) and Law on Border Police (dated 13 July 2009, Official Gazette no. 59/09).

2. Adopt the Law on Public Radio and TV Service of FBiH

Federal Ministry of Communications and Transport

The Law was adopted and published in the Official Gazette of FBiH 48/08.

3. Law on Termination of the Work of the Ombudsman Institution of the Republic of Srpska and transfer of jurisdiction to the Ombudsman for Human Rights of BiH

National Assembly of RS

At the continuation of its 23rd session, RS National Assembly adopted the Law on invalidity of the Law on Ombudsman RS, on 23rd December 2009. The Law was published in the Official Gazette RS, no.118/09. The Law stipulates that within 60 days from the date when the Law entered into force, the entity ombudsman shall cease to exist.

4. Law on Amendments to the Law on Conflict of Interest in Governmental Institutions of BiH

Central Election Commission

On 13 August 2008 the Law on Amendments to the Law on Conflict of Interest in Governmental Institutions of BiH entered into force. The Law was published in the Official Gazette of BiH No. 63/08.

5. Law on prevention of discrimination

Ministry of Human Rights and Refugees

The Law on prevention of discrimination was adopted at the 82^nd session of the Council of Ministers of BiH, held on 2 April 2009, following which it was adopted by the Parliament BiH on 23 July 2009, and published in the Official Gazette no. 59/09.

6. Law on Gas of BiH

Ministry of Foreign Trade and Economic Relations

Adoption of the Law on Gas has been prolonged for 2010. There is no agreement in the expert team about the basic principles of organization of the natural gas sector.

7. Law on Medicaments and Medical Devices

Ministry of Civil Affairs

The BiH Parliament adopted the Law on 17 June 2008 and the Law was published in the Official Gazette of BiH No. 58/08.

8. Law on Public Procurement of BiH - new

Public Procurement Agency

The new text of the Law on Public Procurement has not been passed by the Parliamentary Assembly of BiH.

9. Law on Agriculture, Food and Rural Development

Ministry of Foreign Trade and Economic Relations

The Law was adopted in June 2008 and published in the Official Gazette of BiH No. 50/08.

10. Law on Genetically Modified Organisms

Agency for Food Safety

The Law has been adopted and published in the Official Gazette of BiH No. 23/09.

11. Law on Civil Aviation of BiH

Directorate of Civil Aviation

The Law has been adopted, published in the Official Gazette of BiH No. 39/09 and entered into force.

12. La on the Agency for Provision of Services in Air Traffic of Bosnia and Herzegovina

Directorate of Civil Aviation

The Law has been adopted, published in the Official Gazette of BiH No. 43/09 and entered into force.

13. The Law on Movement and Stay of Aliens and Asylum

Ministry of Security

The Law on Movement and Stay of Aliens and Asylum has been adopted and published in the Official Gazette of BiH No. 36/08

14. Law on Border Control

Ministry of Security

The harmonised text of the Law on Border Control was adopted in the urgent procedure by both Houses of the BiH Parliament (on 10 June 2009 at the 55^th session of the House of Representatives and 15 June 2009 at the 30^th session of the House of Peoples) and published in the Official Gazette of BiH No. 53/09.

15. Amendments to the Law on Execution of Criminal Sanctions, Detention and Other Measures in order to introduce new European standards proposed by the Council of Europe in 2006.

The Law on Amendments to the BiH Law on Execution of Criminal Sanction, Detention and Other Measures, which was published in the Official Gazette of BiH No. 37/09, entered into force on 20 May 2009.

16. Law on Amendments to the Law on Prevention of Money Laundering

Ministry of Security

The Law on Prevention of Money Laundering and Financing Terrorist Activities was adopted by the Parliamentary Assembly of BiH on 15 June 2009 and published in the Official Gazette of BiH No. 53/09.

17. Amendments to the Law on Direct Foreign Investments

Ministry of Foreign Trade and Economic Relations

The Draft Law on Foreign Direct Investment has been referred to the Parliament and is up for its second reading in the House of Representatives of the Parliamentary Assembly of BiH.

18. Law on Real Estate Tax of RS

RS Ministry of Finance

The Law was adopted and published in the Official Gazette of RS No. 110/08; it will be applied as of 1 January 2010.

19. Amendments to the Law on General Safety of Products

Market Surveillance Agency,

Ministry of Foreign Trade and Economic Relations

The Law on General Safety of Products and the Law on Amendments to the Law on the BiH Market Surveillance (which is taken from Dangerous Imitation Directive) adopted and published in

BiH Official Gazette No. 102/09.

20. Law on Amendments to the Law on Free Zones

Ministry of Foreign Trade and Economic Relations

At the 93^rd session of the Council of Ministers of BiH held on 2 July 2009 adopted the Draft Law on Free Zones. The law has been passed and published in BiH Official Gazette No. 99/09.

21. Law on Amendments to the Law on Customs Policy in BiH cancelling 1% fee for customs registration of import of goods

The Law has been adopted and published in the Official Gazette of BiHNo. 93/08.

22. Law on Amendments to the Law on Competition harmonised with the requirements of the SAA

Competition Council of BiH, Ministry of Foreign Trade and Economic Relations

At the 71^st session of the Council of Ministers of BiH of 29 December 2008 the Draft Law on Amendments to the Law on Competition was adopted. The Law was passed on 1 October 2009 and published in Official Gazette No. 80/09.

23. Amendments to the Law on Health Care and Medical Insurance in FBiH

Federal Ministry of Health

In accordance with the conclusions of both Houses of the Parliament of the Federation of BiH, the public debate on the draft Law on Health Protection was conducted in the reporting period. Presently expected is the opinion of the Health Care Committee of the F BiH Parliament House of Representatives on the public debate, as well as the adoption of the final report on the part of the F BiH Parliament House of Representatives, which would provide a basis for preparation of the second phase of this law. It is important to note that this is a new Federation law in this area, so that, upon final sublimation of objections to this law, the first draft of the Law on Health Insurance will be passed on to the cantons. In fact, it is the proposed legal solutions in the Draft Law on Health Protection that the legal solutions in the first draft of the Law on Health Insurance will depend on.

24. Law on Animal Waste

The draft law was prepared by the State Veterinary Office in BiH and submitted to the entities for opinion. The veterinary services department of the RS Ministry of Agriculture, Forestry and Water Management (MAFW) stated the opinion that it is unconstitutional.

25. Law on Welfare of Animals

The Law has been adopted and published in the Official Gazette of BiH No. 25/09.

26. Law on Animal Feed

The provisions of this regulation are built in the new BiH draft Law on Veterinary Medicine.

27. Law on Veterinary Medicines

The draft law was prepared by the State Veterinary Office in BiH and submitted to the entities for opinion. The veterinary services department of the RS Ministry of Agriculture, Forestry and Water Management (MAFW) stated the opinion that it is unconstitutional.

28. Amendments to the Law on Veterinary of BiH

The draft law was prepared by the State Veterinary Office in BiH and submitted to the entities for opinion. The veterinary services department of the RS Ministry of Agriculture, Forestry and Water Management (MAFW) stated the opinion that it is unconstitutional.

29. Law on Census

Statistics Agency of BiH

In June 2009 the Draft Law was returned by the Council of Ministers to the Agency for Statistics of BiH for further harmonisation. The draft Law on Census of Population, Households and Dwellings was not passed in the first reading by the House of Representatives of the BiH Parliamentary Assembly at the session held on January 21^st 2010.

30. Law on Witness Protection Programme in Bosnia and Herzegovina

Ministry of Security

The Draft Law on Witness Protection Program in Bosnia and Herzegovina was in the parliamentary procedure, but it was not adopted, so that the initiative for the adoption of the Law has been re-launched.

31. Law on Copyright and Related Rights

The Law on Copyright and Related Rights was adopted at the 108th meeting of the Council of Ministers held on 10 December 2009.

32. Law on Collective Accomplishment of Copyright and Related Rights

The Law on Collective Accomplishment of Copyright and Related Rights was adopted at the 108th meeting of the Council of Ministers held on 10 December 2009.

33. Law on Patents

The Law on Patents was adopted on the 111th meeting of the Council of Ministers of BiH held on 30 December 2009.

34. Law on Trademarks

Institute for Intellectual Property

The Law on Trademarks was adopted on the 111th meeting of the Council of Ministers of BiH held on 30 December 2009.

35. Law on Industrial Design

Institute for Intellectual Property

The Law on Industrial Design was adopted on the 111th meeting of the Council of Ministers of BiH held on 30 December 2009.

36. Law on Protection of Geographical Indications

Institute for Intellectual Property

The Law on Protection of Geographical Indications was adopted on the 111th meeting of the Council of Ministers of BiH held on 30 December 2009.

37. Law on Origin of Property

Ministry of Justice

The Proposal of the Law on Amendments to the BiH Criminal Procedure Code which, inter alia, governs the confiscation of proceeds of crime, was adopted at 42^nd session of the House of Peoples held on 21 January 2010. The RS National Assembly passed the Law on Confiscation of Proceeds of Crime at its 35^th session held on 26 January 2010.

38. Amendments to the Law on Bankruptcy Procedure in the Federation of BiH
