WHO, with a view to establishing a servitude which permits the hindrance of the natural drainage of water hereby, have declared as follows:

3. The Grantee’s property receives water that naturally drains from the Grantor’s property.
4. The Grantor is willing, in response to the request made of him/her, to allow for the construction of structures on the Grantee’s land which would hinder the natural run-off of water.
5. These declarations having been made, the Grantor hereby establishes over the immovable property described in Clause 1 above, designated as servient land, in favour of the immovable property described in Clause 2, designated as dominant land, with a real and perpetual servitude with regard to the natural drainage of water that would permit the building of a wall and any other structure hindering such natural drainage or run-off, with the expense of back-filling to be borne by the owner of the dominant land, with quality materials, of the servient land close to the wall and the other structures, up to the height of such wall and/or structures.
CONSIDERATION
6. This servitude is granted in consideration of the amount of @QUE209@ dollars ($……………), which the Grantor acknowledges having received on this day from the Grantee, whereof full and final acquittance.
COSTS
7. The costs related hereto, the copies, and the publication shall be borne by the Grantee.
