POWERPLUSWATERMARKOBJECT357831064 THE PUBLIC WATER SYSTEM COORDINATION ACT OF 1977


The Public Water System Coordination Act of 1977 provides that no new public water system be established within a King County critical water supply service area unless it is determined that existing purveyors cannot provide water service in a timely and reasonable manner. King County has established four Coordination Water System Plans (CWSP) to manage future development of public supply in the critical water supply service areas. The County's overwhelming preference and policy framework is for water service to be extended from the utility claiming the service area. An appeals process was developed to review and resolve issues related to the implementation of the CWSP(s). Any person who believes an offer of water service as documented by a Certificate of Water Availability (CWA) is unreasonable or untimely may file an appeal.


An appeal is initiated by the filing of a Notice and Statement of Appeal (insert link) and paying the appeal fee by the prospective appellant. The utility that issued the CWA that is the subject of the appeal will generally file a Response to Notice and Statement of Appeal (insert link). The record will also include the County's policies for public water supply.


The first step in the appeal process is to provide to the appropriate Regional Water Utility Coordinating Committee (WUCC) an opportunity for fact finding, and facilitating a resolution of the appeal. If there is no resolution of the appeal, the WUCC makes a recommendation to the King County Utilities Technical Review Committee as to whether or not the offer of service as documented on the CWA is timely and or reasonable. The WUCC is provided a 45 day time period within which to take action.


If the WUCC is unsuccessful in resolving the appeal, the King County Utilities Technical Review Committee (UTRC) will consider the recommendation of the WUCC and all pertinent information to make a Recommendation and Record of Decision on the appeal. The UTRC decision is based solely upon the written record. It is anticipated the written record will include the information and evidence contained in the Notice and Statement of Appeal to support the appellant’s position, information from the utility that issued the CWA in the Response to Notice and Statement of Appeal, the legal and policy framework of the County for water supply, and the recommendation of the WUCC. The UTRC standard for review of the information is a preponderance of the evidence. The UTRC will issue a Recommendation and Record of Decision on the appeal within 45 day from when the WUCC's recommendation is received. The decision of the UTRC is final unless appealed to the King County Hearings Examiner.
