TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56‑3‑1295 SO AS TO PROVIDE THAT THE TITLE, REGISTRATION, AND LICENSE PLATE OF A DECEDENT’S MOTOR VEHICLE MAY BE REISSUED TO THE DECEDENT’S SURVIVING SPOUSE UPON APPLICATION, AND TO PROVIDE THAT NO FEES ARE CHARGED FOR THESE REISSUES AND THAT THESE REISSUES DO NOT INTERRUPT THE MOTOR VEHICLE TAX YEAR OF THE VEHICLE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 9, Chapter 3, Title 56 of the 1976 Code is amended by adding:
“Section 56‑3‑1295. When a surviving spouse acquires a motor vehicle from the deceased spouse by bequest or operation of law, the department, upon application of the surviving spouse, shall issue a new title, if applicable, in the name of the surviving spouse and reissue the motor vehicle registration and license plate on the vehicle in the name of the surviving spouse. Fees otherwise applicable to these transactions do not apply and the reissue of the motor vehicle registration and license plate in the name of the surviving spouse does not interrupt the motor vehicle tax year of the affected vehicle.”
SECTION 2. This act takes effect on the first day of the second month following approval by the Governor.
