SCHEDULE 202


BT Virtual Mobile Network Service Calls


1. Definitions


1.1 In this Schedule, a reference to a paragraph or Appendix unless stated otherwise, is to a paragraph or Appendix of this Schedule. Words and expressions have the meaning given in Annex D, except as shown below:


BT Virtual Mobile Network

Service” or “BT VMNS” a telephony service provided by BT whereby BT does not itself offer mobile telephony service, but which routes Calls destined for BT mobile numbers allocated to a BT Customer, in accordance with the directions from time to time of such BT Customer:


  1. using mobile terminal apparatus accessed via a Third Party Operator contracted by BT to supply mobile service to such BT Customer; or


  1. using WiFi or WiMax ‘cells’ belonging to BT, or accessed via a Third Party Operator WiFi or WiMax Network contracted by BT, to supply wireless VOIP access to such BT Customer; or


  1. to a Network Termination Point ; or


  1. non-geographically via VOIP; or


  1. to a Call Completion Service; or


  1. otherwise as agreed in writing by the Parties;


BT VMNS Call” a Call from a Calling Party addressed to a BT mobile number range, handed over from the Operator System to the BT System for Call completion by the BT Virtual Mobile Network Service;

Call Completion Service” a service whereby a Calling Party may record a message for later access by the BT Customer;


VOIP” Voice Over Internet Protocol.


2. Description of Service


2.1 Subject to the provisions of this Schedule 202, BT shall deliver BT Virtual Mobile Network Service Calls handed over to the BT System by the Operator System.


2.2 BT VMNS Calls shall be included in the Traffic Forecast in accordance with Annex A.


2.3 The Parties shall agree in advance all necessary technical requirements, including Call set-up and clear down sequences, for the conveyance of Calls pursuant to this Schedule. The Parties shall convey such Calls in accordance with the agreed technical requirements, and shall not make any changes thereto unless otherwise agreed by the Parties.


2.4 BT shall convey BT VMNS Calls handed over from the Operator System during those periods of time and at the same standard and quality of service as BT conveys similar Calls. For the avoidance of doubt this will be dependent on the telecommunications technology utilised for Call completion.


2.5 Each Party shall correct faults which occur in its System which affect the conveyance of BT VMNS Calls in accordance with such Party’s normal engineering practices. For the avoidance of doubt, neither Party warrants that its System is, or will be, free from faults.


2.6 BT Telephony Calls, BT International Incoming Calls, BT Transit Calls, BT Operator to Operator Transit Calls and Calls to Ancillary Services are not conveyed pursuant to this Schedule.


2.7 No payment shall be due to BT in respect of a situation where BT VMNS Calls are made, generated, stimulated, and/or prolonged as a result of any activity by or on behalf of the party operating, or by anyone directly or indirectly gaining from, that BT VMNS disproportionate to the amount and extent of Calls which would be expected from:


(a) good faith usage of; or


(b) acceptable and reasonable commercial practice relating to the operation of;


the telecommunications network.


2.8 Without prejudice to the generality of paragraph 2.7, the following shall not be regarded as good faith usage or acceptable and reasonable commercial practice and usage:


(a) any situation where any member of the public (which shall include partnerships companies and corporations etc engaged in normal commercial, academic or governmental business etc) is misled into making, receiving or prolonging Calls by the party or anyone acting on his behalf operating, or any one else directly or indirectly gaining from, that BT VMNS;


(b) any breach of law or of any then current industry ruling, regulation, convention, policy guidance or statement of principle, including (but not limited to) any such ruling etc of OFCOM, ICSTIS or any successor or similar bodies;


(c) any service which has the effect of preventing the Operator Billing System from capturing necessary billing information;


(d) any use of the telephone network for purposes other than the genuine conveyance of telephone messages for the proper benefit for users of the telephone network.


2.9 The provisions of paragraphs 2.7 and 2.8 are not intended to be limited to cases of Calls made generated or stimulated or prolonged fraudulently but to any situation where there has been an absence of good faith usage or alternatively an absence of acceptable and reasonable commercial practice relating to the operation of the telecommunications network.


3. Routing


3.1 The conveyance of BT VMNS Calls shall be in accordance with the routing principles specified in Annex A for Calls to mobile telephone numbers.


4. Charging


4.1 For the conveyance of each BT VMNS Call by BT, the Operator shall pay BT a charge calculated in accordance with the rate for such a Call specified from time to time in the Carrier Price List.


4.2 If the BT VMNS Call is redirected to a Call Completion Service by BT or the Third Party Operator contracted by BT to supply mobile service to the BT Customer, BT shall procure that the BT System shall immediately return to the Operator System an Address Complete Message immediately followed by an Answer Signal.


4.3 For the avoidance of doubt BT, and the Third Party Operator contracted by BT to supply mobile service to the BT Customer, may return the following tones;


Ring;

Engaged;

Number Unobtainable; or

Equipment Engaged;


or messages limited to direct replacements for those tones provided that any message contains no form of information identifying BT, or the Third Party Operator contracted by BT to supply mobile service to the BT Customer, without first sending an Answer Signal. Before sending any other form of message BT, or the Third Party Operator contracted by BT to supply mobile service to the BT Customer, shall return to BT an Address Complete Message and an Answer Signal.


5. Commencement


    1. BT shall convey BT VMNS Calls handed over from the Operator System commencing on a date to be agreed in writing by the Parties.


6. Review


6.1 Without prejudice to the provisions of paragraph 19 in the main body of this Agreement, and subject to paragraph 19.1.3 of the same, the Parties agree that this Schedule 202 shall be subject to review by either Party serving a review notice in the event of NICC issuing a standard/standards which affects VOIP or BT VMNS Calls.
