Preserving Denied Challenges for Cause



  1. See R.C.M. 912(f)(4) (as amended, effective 13 Nov 05).


  1. You WAIVE your objection to the denied challenge for cause if:


    1. You do not exercise a peremptory challenge, or


    1. You (or your opposition) use a peremptory challenge against the same member you unsuccessfully challenged for cause.


  1. You PRESERVE your objection to the denied challenge for cause if:


    1. You use your peremptory challenge against any member of the panel other than the one you unsuccessfully challenged for cause.
