Amendment Statement of Principles

concerning


ROTATOR CUFF SYNDROME

No. 29 of 2021


for the purposes of the


Veterans' Entitlements Act 1986

and

Military Rehabilitation and Compensation Act 2004

  1. This Instrument may be cited as Amendment Statement of Principles concerning rotator cuff syndrome No. 29 of 2021.

  2. The Repatriation Medical Authority amends, under subsection 196B(8) of the Veterans' Entitlements Act 1986, Statement of Principles concerning rotator cuff syndrome Instrument No. 100 of 2014 (Federal Register of Legislation No. F2014L01376) by:

  1. deleting the word "transfer" in the factors in paragraphs 6(g) and 6(t) and substituting the word "weight-bearing";

  2. inserting the following note to the factors in paragraphs 6(g) and 6(t):

"Note: Examples of situations in which the upper limbs may regularly be used for weight-bearing include transfers from a wheelchair to a chair or bed, and the use of crutches or other walking aids.";

  1. inserting the words "or arm" after the word "hand" in the stem of the definition of "forceful activities" in clause 9;

  2. deleting the words "in the hand" in paragraph (b) of the definition of "forceful activities" in clause 9;

  3. inserting the following note to the definition of "forceful activities" in clause 9:

"Note: Use of crutches or other walking aids and hand propulsion of wheelchairs are included among the types of forceful activities that require generation of force by the hand or arm.";

  1. deleting the definition of "regularly using the upper limbs for transfer" in clause 9.

  1. The amendments made by this instrument commence on 25 January 2021.
