Subject: Rider 82 Adjustments to $110 per WADA Payment


Rider 82 in the General Appropriations Act requires that the additional funding provided ($110 / WADA) be reduced by the amount of gain from changes in the distribution of the Available School Fund caused by the adoption of the “total return” spending policy for the Permanent School Fund. For the most part, this adjustment only affects “budget balanced” school districts, those not otherwise eligible for state aid. For Chapter 41 hold harmless districts, the additional aid from Rider 82 is reduced by the net gain from the Available School Fund and the increase in the amount of recapture payment required.


For the 2003-04 school year, the amount of the reduction in the $110 per WADA supplemental funding that currently appears in the Summary of Finances is based on an increase of $60 in the Available School Fund distribution, reflecting the change from the initial $274 rate to the final rate of $334. However, a significant portion of the increase in the rate was not due to the implementation of the total return spending policy, and therefore should not have been used in the reduction calculations. The proper amount should have been $39, as was used earlier in the year. In the near future, a revised 2003-04 SOF and a revised report entitled Worksheet for Determining the Reduction in Additional Aid from HB 1 will be posted to the TEA web site at http://www.tea.state.tx.us/school.finance/funding/sofweb3.html. If a district is due a refund as a result of this change, the refund will be made by the end of October. If the district had a negative balance for 2003-04 for the foundation school fund at the time of the “Near Final Summary of Finances” (owed funds to the state), the refund amount will be netted against that negative balance.


For the 2004-05 school year, the agency has not yet published a calculation of the reduction that should be made in the Rider 82 payment as a result of the per capita increase. In order to make the calculation accurately for Chapter 41 hold harmless districts, a 2004-05 Cost of Options Report must be generated for each Chapter 41 district.


Beginning with the payment for October 2004, a revised 2004-05 SOF and a report entitled Worksheet for Determining the Reduction in Additional Aid from HB 1 will be posted to the TEA web site. These reports will show how the reduction amount, if any, was derived based on a gain from the total return spending policy. Because of a slightly different revenue estimate for the total return related gain for 2004-05, a rate of $42 per prior year ADA will be used for this purpose. For the Chapter 41 hold harmless districts, the calculation will be based on the best available data from 2003-04 until the cost of options reports are available. Budget balanced districts that are not eligible for the Chapter 41 hold harmless should therefore expect a significant decrease in Rider 82 related funding effective with the October payments.
