Regulations Regarding the Registration of Postal Operators



Decision No.1/7 of the Board of the Public Utilities Commission



Issued pursuant to

Section 9, Paragraph one of the Postal Law

 

1. These Regulations prescribe the content of a postal operator registration notification and a notification of the termination of activities thereof and the submission thereof to the Public Utilities Commission (hereinafter – Regulator), as well as the information to be entered into the Register of Postal Operators.

 

2. The following information shall be indicated by an operator in the postal operator registration notification (Annex 1):

2.1. name;

2.2. unified registration number;

2.3. legal address;

2.4. given name and surname, telephone number, e-mail address and Internet homepage, if any, of the contact person; and

2.5. the date of the commencement of the provision of postal services.

 

3. A postal operator shall submit a notification of the termination of activities thereof to the Regulator, if the postal operator is suspending the provision of postal services completely to all users.

 

4. The following information shall be indicated by a postal operator in the notification of the termination of activities thereof (Annex 2):

4.1. name;

4.2. unified registration number;

4.3. legal address;

4.4. a request to exclude the postal operator from the Register of Postal Operators, indicating the date from which the postal operator is suspending the provision of postal services completely to all users; and

4.5. the payment of the State fee.

 

5. If a postal operator at the moment of submitting a notification of the termination activities thereof has not paid the State fee in accordance with the procedures specified in regulatory enactments, the Regulator shall take a decision in which it shall prescribe the postal operator the duty to pay the debt of the State fee. If a postal operator does not fulfil the decision of the Regulatory regarding the payment of the debt of the State fee, the Regulator shall ensure the fulfilment of the decision of the Regulator in accordance with regulatory enactments.

 

6. The Regulator has the right to request an update in the information indicated in the postal operator registration notification and in the notification of the termination of activities thereof.

 

7. The postal operator has the right to receive a postal operator registration certificate (Annex 3) upon the submission of a written request to the Regulator, which attests the registration of the postal operator in the Register of Postal Operators.

 

8. The Regulator shall enter the following information regarding a postal operator in the Register of Postal Operators:

8.1. name;

8.2. unified registration number;

8.3. legal address;

8.4. registration date;

8.5. date of exclusion;

8.6. the time period for the length of time which the rights to provide postal services have been removed from the postal operator, if a decision of the Regulator has been taken regarding the removal of the rights to provide postal services.

 

9. The Regulator shall indicate the latest date of the update of information of each postal operator in the Register of Postal Operators.

 

10. The Regulator shall ensure public access to the Register of Postal Operators on the Internet website of the Regulator http://www/sprk.gov.lv/.

 

11. These Regulations shall come into force on the day following the publication thereof in the newspaper Latvijas Vestnesis [the Official Gazette of the Government of Latvia].

These Regulations contain legal norms arising from:

1) Directive 97/67/EC of the European Parliament and of the Council of 15 December 1997 on common rules for the development of the internal market of Community postal services and the improvement of quality of service;

2) Directive 2002/39/EC of the European Parliament and of the Council of 10 June 2002 amending Directive 97/67/EC with regard to the further opening to competition of Community postal services;

3) Directive 2008/6/EC of the European Parliament and of the Council of 20 February 2008 amending Directive 97/67/EC with regard to the full accomplishment of the internal market of Community postal services.
