ASSEMBLY, No. 3938

The Assembly Human Services Committee reports favorably Assembly Bill No. 3938.

This supplemental appropriation of $6.4 million in State funds to the Department of Human Services will enable adults with income between 134% and 200% of the federal poverty level to enroll and continue to be enrolled in the NJ FamilyCare program. These State funds will generate approximately $11.9 million in federal funds on behalf of adults with income between 134% and 200% of the federal poverty level.

The FY 2011 appropriations act froze enrollment of adults at 133% of the federal poverty level as of March 2010. At that time, the number of adults enrolled in the NJ FamilyCare program with an income between 134% and 200% of the federal poverty level was 67,000, and by April 2011, that number was reduced to 39,300, a 42% reduction.

This bill is identical to Senate Bill No. 2751 (Vitale), which is pending in the Senate Health, Human Services and Senior Citizens Committee.



MINORITY STATEMENT

We appreciate the sponsors’ intent to expand upon the protections afforded to New Jersey’s most vulnerable citizens in the bipartisan FY 2011 budget, which were provided despite the resource challenges presented in the midst of the most serious economic downturn of a generation.

However, the bill purports to do so in a manner that strains credibility. The bill supplements the FY 2011 budget, meaning that it will effectively expire along with the budget within a week of the earliest possible date that the bill could become law. It is, at the least, extremely unlikely that the proposed program expansion, involving the expenditure of $18.3 million, could be accomplished appropriately and effectively within a week’s time.

The proper course for a significant spending proposal such as this would be to seek to include it in the FY 2012 budget that is to be enacted within two weeks of today’s committee vote. To do so would have required submission of a resolution to the Assembly Budget Committee under the process established by the Joint Rules of the Senate and General Assembly. As that did not occur, this bill may be seen as an attempt to circumvent the resolution process that has been established to ensure timely and careful consideration of proposals for additional spending.

Therefore, we must withhold support for the bill at this time.
