On page 195, between lines 2 and 3 by inserting the following:

"40. (1) No money appropriated in this Act shall be expended for the purposes of human cloning or for intentionally or knowingly purchasing, selling, transferring, or receiving for any purpose, an embryo produced by human cloning or any product derived from an embryo produced by human cloning.

(2) As used in this section:

(a) "Human cloning" means human asexual reproduction, accomplished by introducing nuclear material from one (1) or more human somatic cells into a fertilized or unfertilized oocyte whose nuclear material has been removed or inactivated so as to produce a living organism, at any stage of development, that is genetically virtually identical to an existing or previously existing human organism;

(b) "Asexual reproduction" means reproduction not initiated by the union of oocyte and sperm; and

(c) "Somatic cells" means a diploid cell, having a complete set of chromosomes, obtained or derived from a living or deceased human body at any stage of development.

(d) "Human cloning" means human asexual reproduction, accomplished by introducing nuclear material from one (1) or more humans somatic cells into a fertilized or unfertilized oocyte whose nuclear material has been removed or inactivated so as to produce a living organism, at any stage of development that is genetically virtually identical to an existing or previously existing human organism.

(3) An amount equal to the expenditures of any agency that violates this provision shall be returned to the credit of the General Fund.".
