MACT HAMMER” 112(j)




On March 23, 2002, EPA published the final rule amendments that spell out the requirements for sources of hazardous air pollutants that are subject to “Hammer Provisions” of the Clean Air Act.


This part of the Clean Air Act that outlines the procedures required for making an Equivalent Emission Limit determination for a source category, if EPA has not promulgated a Maximum Achievable Control Technology (MACT) standard for that source category in a timely way. The procedures require affected facilities to submit a permit application in a 2-step process.

New or existing sources that emit hazardous air pollutants (HAPs), located at facilities that are major, and which fall into source categories for which USEPA is late in promulgating MACT standards. Major sources emit 10 tons per year of a single HAP or 25 tons per year combined.
