BE IT REMEMBERED THAT ON THIS 14TH DAY OF DECEMBER, 2020 there came to be held a Regular Session of Commissioners Court of Moore County, Texas in the Commissioners Courtroom in the Courthouse in Dumas, Texas. The following persons were present to-wit: Rowdy Rhoades, County Judge; J. Daniel Garcia, Commissioner Precinct 1; Miles Mixon, Commissioner Precinct 2; Dee Vaughan, Commissioner Precinct 3; Lynn Cartrite, Commissioner Precinct 4; and County Clerk, Brenda McKanna.

Court having been opened according to law the following proceedings were had to wit:

During routine announcements and reports Brandon Cox stated he will go ahead and renew the contract with TruGreen and will place it on the next agenda to be approved. There was a letter presented to the court from the Moore County Junior Livestock Association stating they will go ahead with the stock show in January as scheduled. Copy of letter attached and made a part hereof by references. The Sheriff’s Dept. reported that Rex Christie retired on November 30, 2020 and they would like to start the application process as soon as possible.

Motion was made by Commissioner Vaughan to approve the minutes of the Special Called Meeting of November 13, 2020. Motion was seconded by Judge Rhoades. Motion carried. Motion was made by Commissioner Cartrite to approve the minutes of the Special Meeting of November 23, 2020. Motion was seconded by Commissioner Mixon. Motion carried. Commissioner Vaughan “Abstained.”

Motion was made by Commissioner Cartrite that the bills as presented by James Allen, County Auditor, be approved for payment and the County Treasurer is hereby directed to issue warrant-checks thereof. Motion was seconded by Commissioner Garcia. Motion carried

There was one special handling presented for approval:

Motion was made by Commissioner Cartrite to approve the payment of $6,000.00 per year to Carmen Prul, Public Health Authority for Moore County. Motion was seconded by Commissioner Vaughan. Motion carried.

Motion was made by Commissioner Garcia to approve the Temporary Cash Investments dated December 14, 2020 as presented by James Allen, County Auditor, and the County Treasurer’s Report of Cash Disbursements of the same date be approved and duly recorded in the Commissioner’s Court Minutes. Motion was seconded by Commissioner Cartrite. Motion carried. Copies of the Report and the Temporary Cash Investments are attached and made a part hereof by references.

At 9:14 A.M. motion was made by Commissioner Vaughan that the court enter in Executive Session according to Govt. Code Sec. 551.087 for deliberation regarding economic development negotiations to vote or otherwise dispose of the contents of the Executive Session. Motion was seconded by Commissioner Mixon. Motion carried.

At 10:12 A.M. motion was made by Commissioner Cartrite that the court reconvene in open court. Motion was seconded by Commissioner Garcia. Motion carried. Judge Rhoades stated no action taken on agenda during Executive Session and certifies to the agenda.

Motion was made by Commissioner Cartrite to take “No Action” on commercial or financial information received by a business. Motion was seconded by Commissioner Mixon. Motion carried.

Motion was made by Commissioner Vaughan to approve a contract with Carmen Purl, Moore County Public Health Authority. Motion was seconded by Commissioner Garcia. Motion carried. Copy of contract attached and made a part hereof by references.

Motion was made by Commissioner Vaughan to approve the purchase of a desk in the amount of $972.29 for Moore County Emergency Management. Motion was seconded by Commissioner Cartrite. Motion carried. Copy of invoice attached and made a part hereof by references.

Motion was made by Commissioner Garcia to approve a refund to Scout Energy in the amount of $1,779.69 due to an error in appraised values. Motion was seconded by Commissioner Cartrite. Motion was amended by Commissioner Vaughan to pay refund under protest and stipulate for the County Attorney to investigate if the county has any recourse. Motion was seconded by Commissioner Cartrite. Motion carried. Copy of refund information attached and made a part hereof by references.

Motion was made by Commissioner Mixon to approve the employment of Angie Paquette as a full-time deputy district clerk effective November 9, 2020 with a starting salary of $3,358.59 per month with an increase of $50.00 per month every six months for two years based on performance evaluations. Motion was seconded by Commissioner Garcia. Motion carried.

Motion was made by Commissioner Vaughan to approve the contract with ERAD at a cost of $1,500.00 per year with expenditure to be paid out of District Attorney Seizure Asset Funds. Motion was seconded by Commissioner Cartrite. Motion carried. Copy of contract attached and made a part hereof by references.

Motion was made by Commissioner Cartrite to appoint Kara Milligan as the Moore County Treasurer effective February 1, 2020 upon the retirement of present Treasurer, Pam Cox with her last day being January 29, 2020. Motion was seconded by Commissioner Garcia. Motion carried.

Motion was made by Commissioner Garcia to table the action for the approval of paying Terry Vogel, 69th District Attorney’s Investigator for unused comp time until January. Motion was seconded by Commissioner Mixon. Motion carried.

There was some discussion in regards to approving the resolution to pay Terry Vogel, 69th District Attorney’s Investigator unused comp time from the District Attorney’s Asset Forfeiture Account. The court would like to further investigate to see if the county is liable for the overtime back to 2002. The County Attorney will study the Fair Labors Act to see if the 120/140 hours will apply according to the classification since he is classified as law enforcement. Scott stated extending the decision until January would post the question, if the new District Attorney will allow the county access to the funds under her control to pay the overtime. The court asked Erin Lands, District Attorney Elect if she would be willing to allow the court to use the funds? She stated she would like the court to wait and investigate to see if the county does have to pay it out and stated she would be willing to work with the Court but did not want to commit until the investigation was completed.

Motion was made by Commissioner Cartrite to table until January any action on approving the resolution to pay Terry Vogel, 69th District Attorney’s Investigator for unused comp time out of the 69th District Attorney’s Asset Forfeiture Account. Motion was seconded by Commissioner Vaughan. Motion carried. Copy of resolution presented attached and made a part of hereof by references.

Motion was made by Commissioner Mixon to appoint Nina Morton, Lynn Cartrite, Shelly Burnett, Pam Goolsby and Dee Vaughan to the Moore County Historical Commission for

2021-2022 effective January 1, 2021 with further appointments made at a later date. Motion was seconded by Commissioner Garcia. Motion carried. Copy of information from Texas Historical Commission attached and made a part hereof by references.

Motion was made by Commissioner Vaughan to set a Special Called Meeting for January 1, 2021 to approve bond and deputations of newly elected officials and their deputies with meeting to be held at the Community Building. Motion was seconded by Commissioner Cartrite. Motion carried.

Motion was made by Commissioner Vaughan to cancel the Special Meeting set for December 29, 2020 and approve to pay the bills that would have been presented at that meeting. Motion was seconded by Commissioner Mixon. Motion carried.

Motion was made by Commissioner Mixon to postpone employee appreciation dinner until it can be held in person and do a public notice recognizing people who are eligible to receive awards for their service to the county. Motion was seconded by Commissioner Vaughan. Motion carried.

Dallas Green, Road & Bridge Supervisor presented a report on the department. Dallas stated they are continuing to assist on the Hope Road project, he also contacted Damon White from Fritch and they will start that project in January. Commissioner Garcia stated he received a call from an individual that will be needing some culverts on Schuman Road.

It appears there is no other business to come before the court. Motion was made by Commissioner Mixon to adjourn. Motion was seconded by Commissioner Garcia. Motion carried.
