Na temelju članka 30. stavka 1. Zakona o sklapanju i izvršavanju međunarodnih ugovora (Narodne novine, broj 28/96), Vlada Republike Hrvatske je na sjednici održanoj ................. 2021. godine donijela


UREDBU

o objavi Ugovora između Vlade Republike Hrvatske i Vlade Švedske o prestanku Ugovora između Vlade Republike Hrvatske i Vlade Kraljevine Švedske o poticanju i uzajamnoj zaštiti ulaganja



Članak 1.


Objavljuje se Ugovor između Vlade Republike Hrvatske i Vlade Švedske o prestanku Ugovora između Vlade Republike Hrvatske i Vlade Kraljevine Švedske o poticanju i uzajamnoj zaštiti ulaganja, sklopljen razmjenom nota od 18. lipnja 2020. godine i 26. ožujka 2021. godine, u izvorniku na engleskom jeziku.



Članak 2.


Tekst Ugovora iz članka 1. ove Uredbe, u izvorniku na engleskom jeziku i u prijevodu na hrvatski jezik glasi:

Ministarstvo za vanjske poslove Švedske izražava svoje poštovanje Veleposlanstvu Republike Hrvatske i ima čast cijenjenom Veleposlanstvu prenijeti sljedeće:


Vlada Kraljevine Švedske predlaže Vladi Republike Hrvatske sklapanje sljedećeg ugovora: Ugovor između Vlade Švedske i Vlade Republike Hrvatske o prestanku Ugovora između Vlade Kraljevine Švedske i Vlade Republike Hrvatske o poticanju i uzajamnoj zaštiti ulaganja (Ugovor).


1. Ugovor između Vlade Kraljevine Švedske i Vlade Republike Hrvatske o poticanju i uzajamnoj zaštiti ulaganja, potpisan u Zagrebu 23. studenoga 2000., prestaje važiti.


2. Radi veće jasnoće, stranke Ugovora suglasne su da članak 14.2 Ugovora navedenog u stavku 1., koji produžuje zaštitu ulaganjima učinjenim prije datuma prestanka, prestaje i stoga ne proizvodi bilo kakve pravne učinke nakon stupanja na snagu ovog Ugovora.

Ministarstvo za vanjske poslove Švedske nadalje ima čast predložiti da u slučaju da Vlada Republike Hrvatske prihvaća gore navedeni prijedlog, ova nota zajedno s notom odgovora Vlade Republike Hrvatske čine Ugovor.


Ugovor stupa na snagu na dan primitka obavijesti od hrvatske strane o okončanju svojih unutarnjih postupaka.


Ministarstvo za vanjske poslove Švedske koristi i ovu prigodu ponoviti Veleposlanstvu Republike Hrvatske izraze svog osobitog poštovanja.

Ministarstvo vanjskih i europskih poslova Republike Hrvatske izražava svoje poštovanje Veleposlanstvu Kraljevine Švedske u Zagrebu i ima čast potvrditi primitak verbalne note Ministarstva za vanjske poslove Švedske od 18. lipnja 2020. koja glasi:


„Ministarstvo za vanjske poslove Švedske izražava svoje poštovanje Veleposlanstvu Republike Hrvatske i ima čast cijenjenom Veleposlanstvu prenijeti sljedeće:


Vlada Kraljevine Švedske predlaže Vladi Republike Hrvatske sklapanje sljedećeg ugovora: Ugovor između Vlade Švedske i Vlade Republike Hrvatske o prestanku Ugovora između Vlade Kraljevine Švedske i Vlade Republike Hrvatske o poticanju i uzajamnoj zaštiti ulaganja (Ugovor).


1. Ugovor između Vlade Kraljevine Švedske i Vlade Republike Hrvatske o poticanju i uzajamnoj zaštiti ulaganja, potpisan u Zagrebu 23. studenoga 2000., prestaje važiti.

Ministarstvo ima čast prenijeti da Vlada Republike Hrvatske prihvaća prijedlog sadržan u gore navedenoj verbalnoj noti Ministarstva za vanjske poslove Švedske te da, prema tome, verbalna nota od 18. lipnja 2020. i ova verbalna nota odgovora čine Ugovor između dviju Vlada.


Ugovor stupa na snagu na dan primitka obavijesti od hrvatske strane o okončanju svojih unutarnjih postupaka.


Ministarstvo vanjskih i europskih poslova Republike Hrvatske koristi i ovu prigodu ponoviti Veleposlanstvu Kraljevine Švedske izraze svog osobitog poštovanja.

The Ministry for Foreign Affairs of Sweden presents its compliments to the Embassy of the Republic of Croatia and has the honour to convey to the esteemed Embassy the following:


The Government of the Kingdom of Sweden proposes to the Government of the Republic of Croatia the conclusion of the following agreement:

Agreement between the Government of Sweden and the Government of the Republic of Croatia on the termination of the Agreement between the Government of the Kingdom of Sweden and the Government of the Republic of Croatia on the Promotion and Reciprocal Protection of Investments (the Agreement).


1. The Agreement between the Government of the Kingdom of Sweden and the Government of the Republic of Croatia on the Promotion and Reciprocal Protection of Investments, signed in Zagreb on 23 November 2000, shall be terminated.


2. For greater certainty, the Parties to the Agreement agree that Article 14.2 in the agreement mentioned in paragraph 1, which extends the protection of investment made prior to the date of termination, shall be terminated and shall thus not produce any legal effects after the entry into force of this Agreement.


The Ministry for Foreign Affairs of Sweden has further the honour to propose that in case the Government of the Republic of Croatia accepts the above mentioned proposal, this note together with the reply note from the Government of the Republic of Croatia shall constitute the Agreement.


The Agreement shall enter into force on the day of the receipt of the notification by the Croatian side on the completion of its internal procedures.


The Ministry for Foreign Affairs of Sweden avails itself of this opportunity to renew to the Embassy of the Republic of Croatia the assurances of its highest consideration.

The Ministry of Foreign and European Affairs of the Republic of Croatia presents its compliments to the Embassy of the Kingdom of Sweden in Zagreb and has the honour to acknowledge the receipt of the note verbale from the Ministry for Foreign Affairs of Sweden of 18 June 2020, which reads as follows:


“The Ministry for Foreign Affairs of Sweden presents its compliments to the Embassy of the Republic of Croatia and has the honour to convey to the esteemed Embassy the following:

The Ministry has the honour to convey that the Government of the Republic of Croatia accepts the proposal contained in the above mentioned note verbale from the Ministry for Foreign Affairs of Sweden and, consequently, that the note verbale of 18 June 2020 and this reply note verbale shall constitute the Agreement between the two Governments.


The Agreement shall enter into force on the day of the receipt of the notification by the Croatian side on the completion of its internal procedures.


The Ministry of Foreign and European Affairs of the Republic of Croatia avails itself of this opportunity to renew to the Embassy of the Kingdom of Sweden in Zagreb the assurances of its highest consideration.

Članak 3.


Provedba Ugovora iz članka 1. ove Uredbe u djelokrugu je tijela državne uprave nadležnog za vanjske poslove.



Članak 4.


Na dan stupanja na snagu ove Uredbe Ugovor iz članka 1. ove Uredbe nije na snazi, te će se podaci o njegovu stupanju na snagu objaviti sukladno odredbi članka 30. stavka 3. Zakona o sklapanju i izvršavanju međunarodnih ugovora.



Članak 5.


Ova Uredba stupa na snagu osmoga dana od dana objave u „Narodnim novinama“.

OBRAZLOŽENJE



Vlada Republike Hrvatske je svojom Odlukom o pokretanju postupka za sklapanje Ugovora između Vlade Republike Hrvatske i Vlade Švedske o prestanku Ugovora između Vlade Republike Hrvatske i Vlade Kraljevine Švedske o poticanju i uzajamnoj zaštiti ulaganja, Klasa: 022-03/21-11/15, Urbroj: 50301-21/32-21-2 od 25. ožujka 2021. godine, prihvatila prijedlog Ministarstva vanjskih i europskih poslova za sklapanje navedenog Ugovora.


Tekst Ugovora usuglašen je između Ministarstva za vanjske poslove Švedske i Ministarstva vanjskih i europskih poslova Republike Hrvatske, te je Ugovor potpisan razmjenom nota između Ministarstva za vanjske poslove Švedske i Veleposlanstva Republike Hrvatske u Kraljevini Švedskoj od 18. lipnja 2020. godine i Ministarstva vanjskih i europskih poslova Republike Hrvatske i Veleposlanstva Kraljevine Švedske u Republici Hrvatskoj od 26. ožujka 2021. godine.


Sklapanjem predmetnog Ugovora prestaje važiti Ugovor između Vlade Kraljevine Švedske i Vlade Republike Hrvatske o poticanju i uzajamnoj zaštiti ulaganja, potpisan u Zagrebu 23. studenoga 2000., uključujući i prestanak važenja klauzule o vremenskom ograničenju važenja iz članka 14. stavka 2. Ugovora koja produžuje zaštitu ulaganja učinjenih prije datuma njegovog prestanka.


Provedba Ugovora u djelokrugu je Ministarstva vanjskih i europskih poslova.


Na dan stupanja na snagu ove Uredbe Ugovor iz članka 1. ove Uredbe nije na snazi, te će se podaci o njegovu stupanju na snagu objaviti sukladno odredbi članka 30. stavka 3. Zakona o sklapanju i izvršavanju međunarodnih ugovora.


Provedba ove Uredbe neće zahtijevati dodatna financijska sredstva iz državnog proračuna Republike Hrvatske.
