Item: Welcome and Approval of Minutes

Discussion:

Minutes from March 21, 2019 Board Meeting were approved. Motion moved by Lloyd Dean, 2nd by Rand Austin.

Item: Motor Carrier Division Update – Chad Sheppick

Discussion:

  • Peerless (Price) port construction update: Port will operate on both sides of the road on Hwy 6, MP 238. Building plans finalized next week. Road work will be completed Oct 2020. $14 million total project cost, $12 million of that for roads/grounds

  • Monticello POE - A 360 Smart View addition on Hwy 191 NB & SB in Monticello to bypass eligible vehicles from having to come down US 491 two miles to the port if they don’t need to be seen.

  • Fatalities – 21 CMV related fatalities so far for the year. In 2018 there were 38, and in 2017, 39.

  • Motor Carrier On-line System or MCOLS – have added a shopping cart in to the system so carriers purchasing permits do not have to pay in advance and then have their permit denied for routing, etc. This has drastically reduced our refunds. If you have suggestions, let us know. Ryan Jones suggested a way to replicate permits.

  • Thanks to all our partnerships – we all have different roles, but we all work together well.

  • We don’t know what we don’t know, so let us know how we can better serve you.

  • Paperless Inspections – Paperless is wave of the future – we are testing this at Perry currently. Should be ready next month.

Action Item:

Follow-up on Ryan Jones suggestion of having the ability to replicate permits in MCOLS.

Item: VLS – Richard Stucky & Lane Murphy

Discussion:

  • Richard – going through Perry POE and Echo POE – conflicting messages on what can be done – axle up or axle down?

  • Rick Clark researched extensively through WASHTO and checked with adjoining states. Self steering on power units.

  • Chad felt no difference between trailer and tractor axles. Engineers are nor concerned with this change.

  • Rule is

  • Chairman Ipson asked for a motion to approve this configuration. Motion given by Lloyd Dean, seconded by Rand Austin. Motion approved.

Action Item:

Add this change into the R909-2 rule updates for approval.

Item: Police Escorts – Lt. Harley Watkins – R909-2-19(1)(c)

Discussion:

  • Lt. Watkins presented a change to the Police Escort rule to go from one trooper to two troopers for police escorts. Goal is to do it right and do it safely.

  • It costs carriers 0.57 cents per mile and $75 per hour for an escort.

  • Jake Glover mentioned they approve a police escort oversize load about once a day.

  • Rand Austin made a motion to increase police escort officers from one to two. Lloyd Dean seconded the motion. Motion passed the board.

Item: CMV’s & Technology Corridor construction – Beau Hunter/Andrew Guinn

Discussion:

  • Industry raised question of safety of lane configurations on the I-15 Technology Corridor construction project in Lehi.

  • Before this meeting a ride-along/drive through was arranged between industry, UDOT and UTA. Changes were suggested and are being addressed.

  • Beau mentioned there are construction brown bag meetings and he will make sure all interested parties are invited. There are Committees to share your concerns that the contractors are required to have for their bonuses, etc. You would be welcome to be part of those committees.

  • Chad asked that any time you have/see an issue – reach out to us and we will work with you.

Item: Rule Review & Update R909-2 – Lane Murphy

Discussion:

  • Lane went through the rule (attached) and outlined changes/clean-up that have been updated by the Division and reviewed by the attorney general’s office. All changes are outlined in the rule handout.

  • Chad: R909-2-7(2) (a) – take “power units” and “trailers” out of the sentence.

  • Rand made a motion, seconded by Lloyd for approval of the rule changes to R909-2 – motion passed..

Action Item:

These changes will be sent to the Transportation Commission.

Discussion:

  • Chad went through the rule (attached) and outlined changes that have been updated by the Division and reviewed by the attorney general’s office. Changes necessary from the last Legislative session. All changes are outlined in the rule handout.

  • Rand made a motion to approve, Lloyd Dean seconded the motion – motion passed.

ORGANIZATIONAL UPDATES


Item: UHP, Captain Kincaid & Lt. Watkins

Discussion:

  • Please reach out to us with any questions and concerns.

  • Lt. Spillman ran a special enforcement 2 weeks ago in Garden City, where three recent CMV crashes occurred. 47 inspections, 32 were Level I’s, 3 Level II’s, 11 Level III’s, 1 Level IV’s. This resulted in 14 out-of-service orders and 112 violations, 40 were brake issues. Truck traffic is down a third as a result. Last crash was a dump truck, loaded at 10,000 lbs. over. Working to have reduction in driver error crashes.

  • Top Hands – Thanks to the industry for assistance. Trooper Brad Johnson qualified to go to NAIC – he brought back lots of knowledge.

  • Safety overall is better this year.

Discussion:

  • Thanks to UHP and the Motor Carrier Division for providing instructors for our UTA carrier semionars.

  • Driver Appreciation week is coming up soon. Events include Echo POE on the 10th, Perry POE 11th, and Wendover and St. George on the 12th.

Item: FMCSA – David Garcia

Discussion:

  • FMCSA is continuing charge of deregulation of the industry. Five listening session were held this past year. Five key modifications are open for public comment – trying to grant greater flexibility without jeopardizing safety. Those include:

  • Short haul exemption

  • Adverse driving conditions – 12 & 14 hour rule.

  • 30 minute break modifications – on duty, not driving

  • Sleeper berth provisions.

  • HOS – breaks do not count against 14 hours, but still a 10 hour restart.
