The Borough Clerk read a letter from Fr. William J. Kelly, Pastor, St. Brendan the Navigator Parish, thanking everyone involved in the August 15, 2020 celebration for the Solemnity of the Assumption of the Blessed Virgin Mary and the procession to the beach for the Wedding of the Sea. He states is was one of the highlights of his priesthood.

Kat Laughlin – 19 – 83rd Street thanked the Council for working on this two year process to approve the Dune Vegetation Management Plan 80-83rd Street and looks forward to working with the Administrator on the MOA so the project can be done this Fall.

WHEREAS, the Chief of Police, Thomas J. Schutta has recommended to the Public Safety Committee the hiring of Daniel Gomez for the position of full time police officer for the Borough of Stone Harbor; and


WHEREAS, the Public Safety Committee recommends that Borough Council make this appointment.


NOW, THEREFORE, BE IT RESOLVED by the Members of Council of the Borough of Stone Harbor, in the County of Cape May and State of New Jersey on this 18th day of August, 2020 that Daniel Gomez is hereby appointed as a full-time permanent member of the Stone Harbor Police Department effective August 26, 2019.

Resolution 2020-S-168 (Purchase Trash Truck - COOP)

WHEREAS, the Borough of Stone Harbor entered into Sourcewell (Formally NJPA) #091219-NWY

for the purpose of purchasing a New Way 25’Rear Load King Cobra Trash Truck, mounted on a 2020 108SD-160”Cab to Trunion Freightliner chassis. Furnished and Installed (1) Buyers Steel Muni Plow 10’ along with a 10’rubber deflector; and


WHEREAS, the Borough of Stone Harbor will be using this Co-Op to purchase the new Load King Cobra Trash Truck as per quote attached from DeHart & Son 311 Crown Point Road, Thorofare, N.J. 08086 for a total price of $223,256.50.


NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Stone Harbor, in the County of Cape May on this 18th day of August, 2020 as follows:


NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Stone Harbor, County of Cape May, State of New Jersey that the purchase of a New Way Rear Load Cobra Trash Truck as per quote attached from DeHart & Son for a total price of $ 223,256.50 be approved.

REFUND DISCONNECT FEE


WHEREAS, The Utilities Department evaluated a disconnect fee for the jobsite located at Block 202 Lot 78.02, A.K.A. 10523 Corinthian Dr., and DL Miner Construction Inc. paid for the disconnect; and

WHEREAS, the Utilities Department later determined a disconnect was not required; and,

WHEREAS, the Utilities Collector requests a refund for the disconnect fee; and,

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stone Harbor, in the County of Cape May and State of New Jersey that a refund check in the amount of $525.00 be issued to DL Miner Construction Inc., 11 Clermont Dr. Unit A, Cape May Court House NJ 08210; and

BE IT FURTHER RESOLVED that the Tax/Utilities Collector make the proper adjustment in her records.

Resolution 2020-S-171 (Extend Boot Camp and Farmers Market)

RESOLUTION AUTHORIZING EXTENSION OF BOOT CAMP AND FARMERS MARKET DURING 2020 SEASON


WHEREAS, the Borough of Stone Harbor, in an effort to expand recreational opportunities for resident and visitors has pursued the provision of certain “sport camps” which are extraordinary and not amenable to typical specification processes; and


WHEREAS, agreements to provide such services are acceptable and do not fall under typical specification procedure and are therefore exempt from public bidding in accordance with N.J.S.A. 40A:11-5 as Extraordinary Unspecifiable Services; and


WHEREAS, a contract for the following service has been prepared and is on file with the Borough Clerk: Stone Harbor Boot Camp 2020 Nick Elisano - June 6, 2020 – September 9, 2020 and


WHEREAS, Nick Elisano would like to extend boot camp into September, if not further; and his Liability Insurance covers until 02/01/2021; and


WHEREAS, the Borough’s Farmer Market is now scheduled through September 6, 2020 and the Borough would like to extend the season through the end of September, price $95.00 per space.


NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Stone Harbor, County of Cape May, State of New Jersey, duly assembled in public session this 18th day of August, 2020, as follows;


  1. That the preamble of this Resolution is hereby incorporated herein by reference;

  2. That the Borough Council hereby approves the above mentioned extension of contract for Stone Harbor Boot Camp and the extension of season for the Stone Harbor Farmers Market on behalf of the Borough, subject to the following:


A. Execution of Addendum to the existing Agreement in a form acceptable to the Municipal Solicitor;


B. Receipt of proof of adequate insurance coverage naming the Borough as a named insured.

Mayor Report

I only have a couple of items…

On August 17 the County Health Department reported that Cape May County was below 100 active cases – including out of county cases that have not completed the quarantine period. Remember that the population of the County grows significantly during the summer months so this number is very good news.

I want to take the opportunity to talk about our school. I know a lot of residents have asked about the Stone Harbor/Avalon School District and remarked on the possibility of increased enrollment. I attended the last Stone Harbor School Board meeting via Facebook live on Wednesday, August and learned that between the two schools there are 23 additional students registered. They are all residents of the Seven Mile Island – not tuition students.

Four new students are enrolled in the Avalon School and 19 more students are enrolled in the Stone Harbor School. The breakdown by class in Stone Harbor is Kindergarten four additional students, 1st Grade six additional students, 2nd Grade four additional students, 3rd Grade four additional students, and 4th grade one additional student. The first day of school is September 8th. That first week will be half days for students. The following week begins full days. Monday, Tuesday students in Group A will attend school in person, Wednesday is a remote learning day for all students. Thursday and Friday Group B will attend school in person.

Borough Hall returned to normal business hours last week on Monday, August 10. Employees have all returned to work and the building is open to the public. Hours for Public Access to Borough Hall are, as always Monday – Friday 8:30 am – 4:00 pm. We are continuing to strongly encourage appointments to conduct business. Please call or email in advance with the appropriate office and make your appointment. Please continue to use the drop box located at the 95th Street entrance for routine payments and/or paperwork. Do not enter the building if you feel ill. Just a reminder - face-coverings are required to enter Borough Hall and while inside always maintain social distancing.

Whereas, the Borough Council of the Borough of Stone Harbor is subject to certain requirements of the Open Public Meetings Act, N.J.S.A. 10:4–6, et seq., and


Whereas, the Open Public Meetings Act, N.J.S.A. 10:4–12, provides that an Executive

Session, not open to the public, may be held for certain specified purposes when authorized by Resolution, and


Whereas, it is necessary for the Borough Council of the Borough of Stone Harbor to discuss in a session not open to the public certain matters relating to the item or items authorized by N.J.S.A. 10:4–12b and designated below:


  1. Matters related to purchase, lease, sale or acquisition of real property with public funds.

  2. Pending or anticipated litigation/Attorney/Client Privilege

Now, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Stone Harbor, assembled in public session on August 18, 2020 that an Executive Session closed to the public shall be held on August 18, 2020 at or about 4:30 P.M. in the Borough Hall of the Borough of Stone Harbor, 9508 Second Avenue, Stone Harbor, New Jersey, for the discussion of matters relating to the specific items designated above.


Official action may be taken as a result of said executive session.


It is anticipated that, in accordance with law and in a timely manner, the deliberations conducted in closed session may be disclosed to the public upon the determination of the Borough Council that the public interest will no longer be served by such confidentiality.
