Sex Establishment Applications
Guidance to Applicants
1. General
Before making your application you are advised to read the Councils Policy with regards to Sex Establishments. This can be found on the council website www.medway.gov.uk or a hard copy is available from the Licensing Unit.
2. Applications
You must make your application on the Council’s prescribed form which is available on the council website www.medway.gov.uk or by contacting the customer contact team 01634 333333.
3. Fees
The fees are currently:-

The Licensing Unit can process your payment instantly. When payments are accepted, it can issue you with a receipt via email or send you confirmation in the post. Please have your payment card ready for a member of the unit to enter on the computer system. They will ensure that your card details and personal information remain secure and confidential when using the system. Please do not leave your payment details on voicemail.
The Licensing Unit can take cheques. All cheques are then forwarded to the council's cashiers for processing. Once this is done, a receipt is sent to licensing which is then sent out to the applicant. This can take some time, so please be patient. In some cases the licensing team is unable to complete the processing of your application until the payment is confirmed.
We are unable to take cash payments in licensing. You can make payments by cash by visiting the council contact points Riverside One or Strood Contact Point using the automated till. Payments must be made using an appropriate payment slip or other information to identify the payment. Please note that their is a delay in making cash payments as all documents goes to our cashiers department for processing of the payment and then forwarded to licensing unit.
4. Plans
All new and renewal applications (plans should be submitted for variation applications where it relates to numerous changes to the layout) must be accompanied by:-
A site plan of a radius of ¼ of a mile (scale 1:500) clearly outlining where the sex establishment is to be situated. The plan should clearly identify the proposed sex establishment marking the site/premises boundary with a red line and define other types of businesses and residential properties around the site.
Enclose a scale plan (scale 1:100) of the premises, vehicle, vessel or stall in respect of which the licence is sought. All areas requiring to be licensed should be outlined in red on the plan. Plans may be considered in other scales with prior agreement with the Licensing Authority
Plans should clearly identify the following where applicable:-
The curtilage of the premises
The boundary of the building
External and internal walls and doorways
Where the licence relates to only part of the premises, the part which is to be licensed
Points of access and egress (whether for use by members of the public or not)
Escape routes (where different to the above)
Steps, stairs elevators and lifts
Internal and external CCTV cameras
Show the site where facilities for the public are shared such as toilets and bars.
Tills and pay points
Office facilities and staff rest rooms
And in addition for Sex Shops
The location of any shelving, racking cabinets etc used for the display of stock
Stock rooms
And in addition for Sex Cinemas
The layout of seating and aisles
Location of projection equipment
And in addition for Sexual Entertainment Venues
any stage, floor, podia, pole, cage or other facility where the entertainment will be provided
seating
Staff and entertainers changing rooms, shower and toilet facilities
Land Registry (Premises) or Log Book (Other)
Please send a certified copy of the document of title of the premises (land registry), vehicle (log book), vessel or stall in respect of which the licence is sought.
Financial Documentation
The Council are requesting documentation in relation to a number of financial requirements as we have a duty to make sure no criminal activity is involved with the business such as money laundering, fraud, identify theft and forgery just to name a few.
We therefore require
a copy of the Memoranda and Articles of Association of the applicant, along with a copy of the Memoranda and Articles of Association of any parent company and ultimate holding company.
documentation if you have been made bankrupt, insolvent, company dissolved or company in administration.
a set of audited accounts of the business for the two completed trading years immediately preceding the date of application, or if the business has not traded for that length of time, for the last complete trading year (if the business has been trading for that length of time) immediately preceding the date of application.
7. Photographs and passport/driving licence
This authority is under a duty to prevent and detect fraud. We are therefore, asking for those persons (persons listed on the application form in section A and C) who are involved with the business to prove their identity by
provide a certified copy of a passport or driving licence
provide four copies of a recent passport size photograph, each copy bearing the name in block capitals of the person whose likeness it bears, the signature of the manager/company secretary etc and the date the manager/company secretary etc signed it.
8. Public Safety
Provide a copy of your Risk Assessment relating to the premises.
9. Measures in place to reduce Crime and Disorder
Provide a copy of your Crime Prevention Strategy. This should outline how you will reduce crime and disorder relating to your premises.
10. Management/Staff Procedures
Provide a copy of your Operating Schedule. This document should outline how you intend to operate i.e. how staff and performers will complete their duties and management procedures etc.

Where the application has been made by post you must send a copy of the application (no later than 7 days of the application being made to the Licensing Unite) to:

Where the application has been made using electronic facility it will be the Licensing Unit responsibility to send a copy of your application to the Police.
12. Notices
Applications for New, Variations and Renewal must give public notice of the application by publishing an advertisement in a local newspaper that is circulated in the local authority area no later than 7 days after the date the application is made. Please enclose or forward as soon as possible an extract from a newspaper publishing the notice showing the date of publication.
A notice advertising the application must be displayed on the premises for a period of 21 days beginning with the date the application was made.
