[I/We] refer to our recent discussions regarding your Tenancy at [Insert Tenancy Address].

As you know, the current rent for your tenancy is €[Insert Total Rent] which is payable [weekly/monthly] by [insert payment method].

You have failed to pay rent in accordance with your obligations under the Residential Tenancies Act 2004 (as amended). As of today, [Insert Date], you owe rent arrears of €[Insert Total Rent Arrears] (“Rent Arrears”).

[I/We] confirm that, subject to your agreement to this offer, and your continued compliance with the other terms of your Tenancy and the terms of this letter, the Landlord(s) will waive any right or entitlement to the Rent Arrears.

The arrangement contained in this letter is strictly subject to the following provisions^²:

That you shall continue to pay the Rent in full, with the next payment falling due on [Insert Date];

That it is personal to you, as the Tenant(s) under the Tenancy;

Except to the extent required by law, the Tenant(s) shall not divulge or communicate to any person (other than its professional advisers) any of the terms or content of this letter; and

In all other respects the Tenancy is confirmed. In particular, [my/our] waiver of the Rent Arrears shall not prejudice [my/our] rights and remedies under the Tenancy.

Please signify your acceptance of the foregoing by signing one part of this side letter and returning it to [me/us]. Unless and until that is done, this letter has no effect and you remain liable to pay the Total Rent Arrears in full in accordance with the requirements of your Tenancy.
