A. PROCEDURE: The applicant must submit three copies of the Road Opening/Curb Cut Plan which clearly shows the trench size and curb cut to scale – description of pipe, wires, etc., to be put in place.
1. FILING DATE: Application must be made 14 days prior to start date. The Permit is good for 30 days from date of approval and may be renewed.
2. EMERGENCY PROCEDURES: If an emergency Road Opening must be made, work can be completed by the Town Department or Public Utility before approval is received. However, the Highway Superintendent ____ or Police Chief ____ must give permission. In addition, Police Department ___ and Fire Department ____ must be notified prior to digging, for utility mark out. (Please check off if each above department has been notified.)
3. DETAIL POLICE OFFICER: A New Braintree Police Officer must be on all road jobs that do not have a signed waiver. Detail Police Officers will be hired by New Braintree and paid for by applicant or contractor.
4. INSURANCE: A Certificate of Liability insurance must be on file with Select Board before any work starts. Normally the certification may be submitted with application. But in the case of Emergency work, the certificate must be submitted to the office before any work begins. In some cases, a bond will be required – amounts determined by the Town of New Braintree.
5. LIABILITY: The applicant assumes all liabilities of claims to both vehicles and pedestrians resulting from the road opening.
6. MAINTENANCE OF OPENING: The applicant is responsible for one year for the repair and maintenance of the road opening. If the applicant does not make the repair, the highway department will bill the applicant for materials and labor used to make the repair.
7. ROAD REPAIR: Will be done according to MHD Specifications with possibly additional requirements from the Town of New Braintree, new fill, 3 ½ inch asphalt (minimum), thicker if deemed necessary.
8. SIGNS AND UTILITY POLES: Will any need to be moved or installed to accomplish the road opening? Yes or No (Circle One)
9. TREE REMOVAL: Will any Town trees be removed by the construction of this road opening? Yes or No (Circle One)
